By creating an account or using any TopAgent service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and TopAgent.
TopAgent provides an AI-powered platform that transforms real estate photographs into video walkthrough content. The service includes automated video generation, branding tools, music library access, and video export capabilities.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree not to use TopAgent to:
You retain all rights to the photographs and content you upload to TopAgent. You own all video content you generate using the service, subject to the following: TopAgent retains a limited license to use generated videos for service improvement, demonstration, and marketing purposes (with your explicit consent where required by law). TopAgent's technology, software, and platform are proprietary and protected by intellectual property laws.
Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law or as expressly stated in our refund policy. You authorize us to charge your payment method for all fees associated with your account.
New accounts may be eligible for a free trial. During the trial period, you may use the service subject to these Terms. TopAgent reserves the right to limit or revoke trial access at any time.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. No partial refunds are provided for unused subscription time.
TopAgent IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TopAgent SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO TopAgent IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless TopAgent and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the service, violation of these Terms, or infringement of any third-party rights.
We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We may also update these Terms from time to time. Continued use of the service after any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TopAgent operates, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of that jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
